Welcome to TFrancisco B.V. We offer a subscription-based software development service, specializing in web development. By subscribing to our services, you are agreeing to comply with and be bound by the following terms and conditions of service, which together with our privacy policy govern TFrancisco B.V.'s relationship with you in relation to this website and our services.
TFrancisco B.V. provides software development services on a subscription basis. This service is tailored for web development projects and is delivered through a monthly subscription model.
Subscriptions are paid monthly in advance via payment methods supported by Stripe. In case of late or failed payments, please contact contact@tfrancisco.dev for resolution.
The billing cycle for subscriptions to TFrancisco B.V. services is anchored to the starting date of the contract, recurring monthly. This means that the billing period begins on the date the subscription is activated and recurs on the same date each month thereafter. Payment for the upcoming month's subscription is due in advance and will be automatically processed using the payment method on file with Stripe.
Refunds are not normally issued by TFrancisco B.V. due to the nature of the work. In the exceptional case where a refund is granted, all work produced up to that point remains the property of TFrancisco B.V. The client gives up any rights or permissions to use, sell, or distribute this work. This agreement takes effect immediately when a refund request is made. TFrancisco B.V. retains the right to utilise the work in any manner deemed appropriate.
Clients must follow the provided instructions to submit work requests through Trello. There are no limits to the number of requests per month; however, delivery is subject to the rules of the subscribed tier. Review and updates on work requests will be provided on average within 48 hours.
For presentation and marketing purposes, TFrancisco B.V. may use the client's name, logo, and technology stack. Publication of any additional information requires a mutual agreement between the client and TFrancisco B.V.
Upon delivery and full payment, the client obtains full ownership of the intellectual property, except in the case where a refund is issued.
TFrancisco B.V. commits to maintaining the confidentiality of all client information. Our privacy policy complies with GDPR, ensuring that client information is only used for service provision and billing purposes.
TFrancisco B.V. provides no warranties for the services rendered. Liability for any service failure or error is limited to €500,000.00 per event, with a cap of €1,000,000.00.
Either party may cancel the subscription at any time. Upon client cancellation, services continue until the end of the current billing cycle. If cancellation is initiated by TFrancisco B.V., a proportional refund for the remaining subscription period will be issued.
The "Pausing Subscription" feature offered by TFrancisco B.V. allows for a temporary suspension of service for up to three consecutive months. During this period, any remaining days of the current billing cycle are saved and can be used within three months after reactivation. Subscribers have the responsibility to manage the pause and reactivation of their subscription through the Stripe platform, and should ensure all necessary project requirements are addressed before initiating a pause. Automatic cancellation of the subscription occurs if it remains paused for three months.
These terms and conditions are governed by Dutch law. Any disputes related to these terms will be resolved exclusively in the competent courts of The Netherlands.
TFrancisco B.V. reserves the right to modify these terms and conditions at any time without prior notice. Continued use of our services after such changes will constitute acknowledgment and acceptance of the modified terms and conditions.
Clients are responsible for providing all necessary information and feedback required for project completion. Failure to provide such information may impact service delivery and deadlines.
